This notice explains how and why we collect and manage personal data, what your data protection rights are and how you can exercise them. One of our responsibilities is to ensure that the personal data we hold about you is accurate and current. Types of Data we collect

We collect and process a range of personal data, that is, information about an identifiable individual. We only collect data that is necessary to provide you with services requested, to keep you informed and to carry out our business. There are occasions where you can limit the information you provide to us, but please bear in mind this may limit the service or level of personalisation we can offer. Among the types of Personal Data that this Website collects, by itself or through third parties, there are: Cookies; Usage Data; email address.

Information we collect directly from you

We collect certain information directly from you. This may be via our website (for example data that you provide by filling in a contact form on our website, subscribing to our newsletter, including data provided at the time of requesting information) or when you make a request or query, whether by email, via our websites or on the telephone. You may also provide personal data to us when engaging with us as a client or through surveys, interviews or research conducted on behalf of a client.

Some of the information we hold about you may be provided to us via third-party sources, for example reviews or comments on social media such as Twitter.

Information collected by us automatically about you

As you interact with our website, we may automatically collect analytics data about your equipment, browsing actions and patterns, to provide you with the best experience and help you to make use of certain functionality. Why we use your personal data

The law requires us to ensure we have a lawful basis for processing your personal data. We only use your personal data when we believe it is lawful to do so.

Do you have to provide personal data?

If we need to collect personal data by law, or under the terms of a contract we have with you, and you choose not to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to return a message). In this case, we may be unable to process this communication – but we will notify you if this is the case at the time.


Online recording

From time to time we may record user sessions or interviews to gather information about a project or conduct research for a project you may have asked us to do. You will be notified before if this information will be recorded. By joining a recorded session you are giving your consent to be recorded.


Data security and retention

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those agents, contractors and other third parties who have a business need to know.

They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We regularly review and update our procedures to deal with any suspected personal data breaches. In the event of any suspected personal data breach we will notify the individuals affected and the applicable data protection regulators, where legally required to do so.


International data transfers

Personal data may be transferred outside of the UK to other third-party service providers incidentally in the course of our activities. We will take steps to ensure that adequate protection is provided for information transferred overseas as required under data protection legislation.


Retention time

We aim to keep personal data only for as long as is necessary to fulfil the purposes for which the data was collected.

Opting out of communications

You can ask us to stop sending you newsletters and messages at any time by:

- Following the opt out (unsubscribe) link on any newsletter sent to you

- Contacting us at any time at hello@unthinkabledigital.co.uk

We will implement your request as promptly as possible, but it can take up to 28 days to remove you from our mailing list, so you may still receive communications during this time.


Your data protection rights

You have a number of legal rights in relation to your personal data. You have the right to:

- Request access to your personal data (commonly known as a 'data subject access request'). This enables you to receive a copy of the personal data we hold about you and to check that we are processing it lawfully.

- Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

- Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which, if applicable, will be shared with you at the time of your request.

- Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party), and there is something about your particular situation that makes you want to object to processing on this ground, as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information that override your rights and freedoms.

- Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data's accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

- Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information that you initially provided consent for us to use, or where we used the information to perform a contract with you.

- Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain services to you. We will advise you if this is the case at the time of your request.

These don't apply in all circumstances, as there are also legal exemptions which may apply, depending on why we have collected the data, and the legal basis on which we are holding the data. We will be happy to explain if you have questions about this.

Details about the right to object to processing

Where Personal Data is processed for a public interest, in the exercise of an official authority vested in the Owner or for the purposes of the legitimate interests pursued by the Owner, Users may object to such processing by providing a ground related to their particular situation to justify the objection.

Users must know that, however, should their Personal Data be processed for direct marketing purposes, they can object to that processing at any time without providing any justification.


How to exercise these rights

Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by the Owner as early as possible and always within one month.

Changes to this privacy policy

This privacy notice was last updated on 25 September 2023.

The Owner reserves the right to make changes to this privacy notice at any time by notifying its Users on this page and possibly within this Website and/or - as far as technically and legally feasible - sending a notice to Users via any contact information available to the Owner. Please check this page occasionally to ensure that you’re happy with any changes, referring to the date of the last modification.

Should the changes affect processing activities performed on the basis of the User’s consent, the Owner shall collect new consent from the User, where required.
